1. Acceptance of Terms

By creating an account or using Declare Flights, you agree to these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use our service.

2. Description of Service

Declare Flights provides a digital logbook and passenger declaration management tool for private pilots in the United Kingdom.

3. CAP 1590 Compliance Disclaimer

Important Notice

Declare Flights is designed to assist pilots with managing passenger declarations for cost-sharing flights in accordance with CAP 1590 guidance. However:

  • 1.We do not guarantee regulatory compliance. It remains the pilot's responsibility to ensure all flights comply with applicable regulations.
  • 2.Our service provides tools to help you meet CAP 1590 requirements, but does not constitute legal advice or regulatory approval.
  • 3.You are responsible for verifying that your use of cost-sharing complies with your licence privileges and current regulations.
  • 4.The CAA may update CAP 1590 guidance at any time. We endeavour to keep our service current, but you should verify requirements independently.

4. User Accounts

Account Creation

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials.

Account Security

You are responsible for all activities that occur under your account. You must notify us immediately of any unauthorised access or security breach.

Account Eligibility

You must be at least 18 years old and hold a valid pilot licence (or be training for one) to create a pilot account. Passengers signing declarations may be of any age, with minors requiring guardian consent.

5. Acceptable Use

You agree not to:

Use the service for any unlawful purpose
Create false or misleading entries
Impersonate another person or pilot
Attempt unauthorised access
Interfere with or disrupt the service
Use automated access without permission
Upload malicious code or content
Share account credentials with others

6. Subscription and Payment

Free and Paid Plans

We offer both free and paid subscription plans. Features and limitations are described on our pricing page.

Payment Processing

Payments are processed securely by Stripe. By subscribing, you agree to Stripe's terms of service.

Billing & Renewal

Paid subscriptions are billed monthly or annually. Your subscription automatically renews unless cancelled.

Cancellation

You may cancel at any time. You retain access to paid features until the end of your billing period.

Refunds

We offer a 14-day money-back guarantee for new subscriptions. Later refunds are case-by-case.

Plan Downgrades

If you downgrade, existing data is preserved but you may not add new records if over free plan limits.

7. Data and Content

Your Data

You retain ownership of all data you enter. You grant us a limited licence to store, process, and display your data to provide the service.

Data Accuracy

You are responsible for the accuracy of all data you enter. False or misleading entries may have regulatory implications.

Data Export

You may export your logbook data at any time through the service.

Data Retention

Signed declarations are retained for minimum 6 months from flight date as required by CAP 1590.

8. Declarations and Signatures

Electronic Signatures

Passengers may sign declarations electronically. By using the declaration feature, you acknowledge that electronic signatures are legally binding and equivalent to handwritten signatures for CAP 1590 compliance.

Passenger Responsibility

When passengers sign, they confirm they have read and understood the CAP 1590 essential information. The pilot is responsible for ensuring passengers have adequate opportunity to review this information.

Minor Passengers

For minors, a parent or guardian must sign on their behalf. The pilot is responsible for correctly identifying minors and obtaining guardian signatures.

9. Intellectual Property

Our Intellectual Property

The Declare Flights service, including its design, features, and content, is protected by copyright, trademark, and other intellectual property laws.

Feedback

Any feedback, suggestions, or ideas you provide may be used by us without any obligation to you.

10. Third-Party Services

Our service integrates with third-party services including Stripe for payments and email providers for notifications. Your use of these services is subject to their respective terms of service.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

WE SPECIFICALLY DISCLAIM ANY WARRANTY THAT THE SERVICE WILL ENSURE REGULATORY COMPLIANCE. COMPLIANCE WITH AVIATION REGULATIONS IS SOLELY YOUR RESPONSIBILITY.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DECLARE FLIGHTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

This includes but is not limited to:

Loss of profits, revenue, or data
Regulatory penalties or fines
Loss of licence or flying privileges
Business interruption
Damages from reliance on the service

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify and hold harmless Declare Flights from any claims, damages, losses, or expenses arising from:

Your violation of these Terms
Violation of applicable laws or regulations
False or misleading information you provide
Any regulatory action from your flights

14. Termination

Termination by You

You may terminate your account at any time by contacting us or using the account deletion feature. Some data may be retained as described in our Privacy Policy.

Termination by Us

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason at our discretion with reasonable notice.

Effect of Termination

Upon termination, your right to use the service ceases immediately. We may retain certain data as required by law or for legitimate business purposes.

15. Changes to Terms

We may modify these Terms at any time. Material changes will be notified via email or through the service. Continued use of the service after changes constitutes acceptance of the modified Terms.

16. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be resolved in the courts of England and Wales.

17. General Provisions

Severability

If any provision is found unenforceable, the remaining provisions continue in effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Declare Flights.
